A. Controller

We are pleased that you are visiting a website of Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg, Germany, e-mail: carnet-support@volkswagen.de, registered in the Commercial Register of the Municipal Court Braunschweig (Braunschweig District Court) under No. HRB 100484 (Commercial Register, Section B) (”Volkswagen AG”and we would like to thank you for your interest in our company and our products. Below, we would like to inform you on the collection, processing and usage of your data.

B. General information, protocol data

In principle, you can visit the web sites of Volkswagen AG without disclosing to us who you are.

We will in this case receive only the following protocol data in automated fashion:

  • An anonymous cookie ID which does not make it possible to infer your IP address,
  • The operating system you are using, the web browser you are using and the screen resolution settings which you are using,
  • The date and time of day of your visit,
  • the web sites which you have visited of us and
  • the web site from which you are visiting our web site.

Insofar as the following sections contain nothing to the contrary, the data processing is undertaken exclusively by Volkswagen AG.

C. Collection, processing, and usage of your personal data

Your personal data includes information such as your surname, first name, your address, your phone number or your e-mail address. Personal data shall be only be collected, processed and/or used if you provided us with this information for the purposes of the substantiation, content-related formulation or amendment of a contractual agreement concluded between you and us or you have registered for personalised services, or if you have sent us an inquiry through the website. In addition, your personal data is only used if you have provided your prior consent, e.g.: to obtain advertising and for market research purposes.

I. Subscribing to publications and a newsletter

Through this website, you have the option to subscribe to a newsletter or publications issued by Volkswagen AG, such as Volkswagen AG business reports, and you can also contact us. We only process the data provided in this context for the purpose of providing this service according to the consent given by you. For this purpose, Volkswagen AG uses the so-called double opt-in process. Under this process, an e-mail will be sent to the e-mail address you provided with the request asking that you confirm your consent. You have the right to withdraw your consent at any time with future effect towards Volkswagen AG, via the following e-mail address: Datenschutz@volkswagen.de

Through this website, you have the option to order publications such as Volkswagen AG catalogues. For this purpose, we will require the following personal information: Surname, first name, address. These data shall be used by Volkswagen AG (while deploying a data processor) only for the purposes of the substantiation, content-related formulation or amendment of the contractual agreement concluded between you and us upon a free-of-charge basis in order to subscribe to publications (Art. 6 (1), Sentence 1 lit. b of the General Data Protection Regulation, GDPR). The collected data shall be deleted after the requested publication has been sent insofar as no other retention timeframes (e.g. tax-related retention timeframes) oppose this.

This web site also offers the option of subscribing to a newsletter. The data provided in this context (e-mail address and optionally surname, forename) shall be used by us exclusively for the purpose of rendering this service based upon the consent which you have granted (Art. 6 (1) Clause 1 lit. a GDPR). For this purpose, Volkswagen AG uses the so-called double opt-in process. Under this process, an e-mail will be sent to the e-mail address you provided with the request asking that you confirm your consent. You may, at any time and upon a free-of-charge basis, withdraw your consent – with effectiveness for the future – vis-à-vis Volkswagen AG, e.g. by clicking on the “Cancel” link which is contained in every newsletter or by using the following website:  https://datenschutz.volkswagen.de. If you cancel the newsletter, your personal data shall be deleted provided no other retention timeframes (e.g. tax-related retention timeframes) oppose this. The sending of the newsletter shall be undertaken by deploying a contracted data processing service provider to do so.

II. Test drive

If you are interested in one of our vehicles, you can submit a test drive request via our website. For this purpose, Volkswagen AG collects the following personal data, which it transmits to the selected service partner: Name, title, salutation, e-mail address; if you wish to be contacted by telephone by your selected service partner, we will also collect your phone number. Data is collected and transferred on the basis of negotiating and completing or executing a contract (Art. 6 (1) Clause 1, lit. b GDPR) to carry out a test drive through the selected service partner. The transferred data are used by the service partner for the purposes of contacting you via your preferred service channel. After they have been transmitted to the service partner, the data provided by you is deleted by Volkswagen AG. The service partner deletes the data after the test drive has taken place, insofar as no other retention timeframes (e.g. tax-related retention timeframes) oppose this.

Sharing of data

Personal data is only shared with third parties if necessary, in particular for the purpose of processing contracts. This is the case, for example, if you use Google Inc.’s Google Map service (”Google”) to find a dealer and then this is displayed on your map.

III. Declaration of consent for the purposes of advertising and market research

If you would like to continue to receive information on our products, you can subscribe to advertising. For this purpose, within the context of consent granted by you (Art. 6 Para. 1 Sentence 1 Letter a General Data Protection Regulation (GDPR)) the following data will be processed for the purpose of sending you advertising: Surname, name, e-mail address and/or phone number. To obtain consent, Volkswagen AG uses the so-called double opt-in process. Under this process, an e-mail will be sent to the e-mail address you provided with the request asking that you confirm your consent. IV. Requirements-based advertising (targeted advertising)

For the purposes of displaying content and targeted advertising, Volkswagen AG creates browser-linked user profiles (in accordance with § 15 Para. 3 Telemedia Act). In this case, browser-linked data means that it is not possible to link to your physical identity, but rather, that only your browser can be identified through the use of identifiers in cookies. Cookies are small text files containing configuration information that is saved to your device. Information about your website activities is recorded (e.g.: browsing behaviour, sub-pages visited from internet offerings, advert banners you clicked on, etc.) In principle, contents are pseudonymised when saved. This means that possible identification characteristics are replaced by an identifier, with the purpose of preventing or making it difficult to identify the party in question.

Profile information contains a limited amount of business-relevant behavioural elements. Without disclosing your personal information, they allow algorithms evaluate your click behaviour on Volkswagen websites in real-time and to work with prognoses, in order to create selective, personalised and relevant promotional advertising and to display targeted online advertising campaigns.

Most web browsers are set to automatically accept all cookies. You can revoke consent with future effect at any time after a pseudonymised usage profile has been created by changing the settings on your browser so that it does not accept any cookies or only certain cookies, and so that you are informed whenever cookies are sent.   • Evergage
    Evergage is a client-based personalisation tool. On the basis of the aforementioned usage evaluation, this solution makes it possible to display personalised contents without recognising personal data.
  • Sizmek
    Sizmek is a specialised provider of web campaign management activities. Cookies save information to track, monitor and optimise advertising campaigns for targeting and retargeting purposes for up to 90 days.   • Sophus3
    Sophus3 is a provider of website analysis and optimisation. For additional information on Sophus3, see the link below.
  • Adobe AudienceManager
    This solution creates and uses target group segments as data management platforms for digital channels.
  • Smart Signals
    On the basis of the aforementioned usage evaluation, Smart Signals controls the display of personalised content on Volkswagen websites. No personal data is collected or processed for this purpose.
  • Ensighten
    Ensighten is a tag management tool that controls the tag integrations described here. Ensighten does not collect any personal data.

D. Tracking Tools

I. Adobe Analytics

This website uses services provided by Adobe (Analytics, SiteCatalyst and Dynamic Tag Manager) to analyse user visits to this website. The data processing shall be undertaken for the purposes of advertising, market research or the requirements-based design of our web site (in accordance with Section 15 Para. 3 of the German Telemedia Act. The Adobe Analytics solution allows us to analyse the usage behaviour of Volkswagen online offerings and to use this information to make continuous improvements. Elements used in the analysis include, for example, websites visited or services, amount of time spent on a page, click paths - technically trackable patterns of use. Without collecting personal data, we can determine which pages, topics, products or contents are important to our users based on the usage.

Determining usage data is a functional component of the offerings on this website and also includes marketing-relevant information through the existence of analysis functions. Please note that functional tracking, as well as tracking for the purposes of marketing can be controlled independently of the other.

Adobe’s dynamic tag management allows us, as a website provider, to flexibly link and easily manage services (e.g. Adobe marketing services), thereby improving our interactions with interested parties. A tag is a website code element written in JavaScript programming language. To use this tag, it must be embedded on every desired html page, so that the code element can become active when a website is called up. Adobe Dynamic Tag Management regulates tag embedding from a central location and makes it possible to control which services are linked and where, in addition to collecting data and activating services.

For the purposes of carrying out an analysis using Adobe services, cookies are stored on your terminal device and used to collect information that is stored on the servers of Adobe Systems Software Ireland Limited (“Adobe”). We cannot preclude the possibility that your data will be accessed through Adobe Systems Incorporated having headquarters in the USA, such that a corresponding EU standard agreement (adequate guarantees regarding the processing of data in non-European countries) was concluded. You have the right to be informed of this standard agreement in the course of the disclosure.

The information stored on the Adobe servers cannot be directly traced to an individual because Adobe Analytics is used with the following settings: “Before Geo-Lookup: Replace visitor’s last IP octet with 0” and “Obfuscate IP-Removed”. The setting “Before Geo-Lookup: Replace visitor’s last IP octet with 0” causes the IP address to be anonymised prior to so-called geo-location by substituting the last octet in the IP address with zeros. For statistical analysis, the user's approximate location is added to the tracking package, which still contains the complete IP address. Before the tracking package is saved, the IP address is then replaced by a single, permanent IP address - referred to as a generic IP address - when the setting “Obfuscate IP-Removed” is configured. This removes the IP address from the data record that is stored.

E. Your rights

Your rights, as listed below, are exercisable free of charge at any time by contacting Volkswagen AG. Additional information on exercising your rights can be found under Section F.

Right to rectification: You have the right to request that we correct any of your personal data that is incorrect or incomplete.

Right to erasure: You have the right, in the event that the requirements specified in Art. 17 of the General Data Protection Regulation (GDPR) have been met, to demand the deletion of your data. Thus, in accordance with this article, for example, you may request the deletion of your data insofar as these data are no longer required for the purposes for which they were collected. Furthermore, you may demand the deletion of these data if we process your data based upon the consent which you have granted and you then withdraw this consent.

Right to restriction of processing: You have the right to request the restriction of the processing of your personal data if the requirements specified under Art. 18 GDPR have been met. This is the case, for example, if you dispute the accuracy of your data. For the duration of the verification of the correctness of the data, you can request that the processing of your data be restricted.  

Right to object: Insofar as the processing is predicated by an overriding, legitimate interest or your data are being used for direct marketing purposes, you have the right to object to the processing of your data. An objection shall be permissible if the processing either is carried out in the public interest or in the exercising of official authority or owing to a justified interest of Volkswagen AG or of a third party. In the event that you object, we request that you inform us of the reasons why you are objecting to the data processing. In addition, you shall have the right to object to the data processing for the purposes of direct advertising. This shall also be valid for profiling insofar as this is undertaken in conjunction with the direct advertising.

Right to data portability: Insofar as the data processing is undertaken based on a consent or a fulfilment of a contractual agreement and this is also undertaken while using an automated processing system, you have the right to receive your data in a structured, standard and machine-readable format and to transfer these data to another data processing service provider.

Right of revocation: Insofar as the data processing is undertaken based upon a consent, you have the right to withdraw your consent for the data processing, with future effect at any time, free-of-charge.

Right to lodge a complaint: You also have the right to lodge a complaint with a supervisory authority (e.g.: with the State Data Protection Officer for Lower Saxony) regarding our processing of your data.
